11. COOKIES AND AUTOMATIC DATA COLLECTION
JMM Compliance uses a limited number of cookies and similar technologies on its public website for advertising measurement — specifically, to determine whether a visitor who arrived from an advertisement later submitted a request.
These technologies are configured for measurement only. Advertising personalization signals are disabled, and JMM Compliance does not use them for behavioral tracking, cross-site advertising profiles, or the creation of individual user profiles.
JMM Compliance's website forms may collect information that a visitor voluntarily enters into the form.
Our website may nevertheless rely upon technology provided by our website hosting provider, web platform, security provider, or other infrastructure provider that may technically process limited information necessary to operate, secure, or deliver the website.
JMM Compliance does not intentionally use such information to create behavioral advertising profiles unless our practices change.
Visitors who prefer not to be included in this measurement may block or delete cookies through their browser settings, or adjust their Google advertising settings at google.com/settings/ads.
If we introduce analytics, advertising pixels, cookies, behavioral tracking, or similar technologies in the future, this Privacy Policy may be updated to describe those technologies and their purposes.
12. GOOGLE ADVERTISING
JMM Compliance may advertise through Google Search and related Google advertising services.
Our current advertising activities are intended primarily to allow prospective clients to discover JMM Compliance when searching for transportation compliance and related services.
JMM Compliance uses Google's conversion measurement tag on its public website. When a visitor arrives from a Google advertisement and later submits a request, the tag reports to Google Ads that a conversion occurred. Google may set cookies in the visitor's browser for this purpose.
Advertising personalization and remarketing signals are disabled. JMM Compliance does not use Google advertising services to build remarketing audiences or to serve advertisements based on a visitor's browsing behavior.
JMM Compliance does not sell personal information to Google or provide Google with client records for the purpose of selling such information.
If our website or advertising configuration changes to use additional Google analytics, conversion-tracking, remarketing, cookies, pixels, or similar technologies, our privacy practices and disclosures may be updated accordingly.
13. THIRD-PARTY SERVICE PROVIDERS
JMM Compliance may use third-party service providers when reasonably necessary to provide services or operate the business.
Examples may include:
- Drug and alcohol consortium providers;
- Electronic logging device providers;
- Clearinghouse-related service providers;
- Website hosting providers;
- Email providers;
- Telephone providers;
- Document-management providers;
- Technology providers; and
- Other vendors necessary to provide requested services.
JMM Compliance seeks to use service providers appropriate for the nature of the services being performed.
Where reasonably appropriate, JMM Compliance may require service providers handling confidential information to maintain appropriate safeguards and use the information only for authorized purposes.
14. DATA SECURITY
JMM Compliance takes the security and confidentiality of information seriously.
We maintain administrative, technical, and physical safeguards that are reasonably designed to protect information in our possession or control against unauthorized access, acquisition, use, disclosure, alteration, loss, or destruction, taking into account the nature and sensitivity of the information and the circumstances under which it is maintained.
Depending upon the circumstances, safeguards may include measures such as:
- Limiting access to information based upon legitimate business needs;
- Using account authentication and access controls;
- Maintaining reasonable password and account-security practices;
- Using reputable technology and service providers;
- Protecting information during transmission where appropriate;
- Maintaining reasonable physical protections for records and devices;
- Limiting disclosure of information to authorized persons or service providers;
- Maintaining procedures designed to identify and respond to suspected security incidents;
- Securely disposing of information when it is no longer reasonably necessary; and
- Periodically reviewing security practices as business operations and technology change.
NO METHOD OF TRANSMISSION, STORAGE, OR ELECTRONIC PROCESSING CAN BE GUARANTEED TO BE COMPLETELY SECURE.
Accordingly, while JMM Compliance takes reasonable measures designed to protect information, we cannot and do not guarantee that information will be immune from every possible unauthorized access, cyberattack, theft, loss, interception, technical failure, or other security incident.
We will not knowingly make representations that our security measures are “100% secure,” “unhackable,” or otherwise immune from compromise.
If JMM Compliance becomes aware of a security incident involving personal information, we will evaluate the incident and take reasonable steps consistent with applicable law, including any legally required notifications.
15. DATA RETENTION
JMM Compliance generally retains information only for as long as reasonably necessary for legitimate business purposes, including:
- Providing or completing requested services;
- Maintaining client and business records;
- Complying with applicable legal, regulatory, accounting, or recordkeeping obligations;
- Resolving disputes;
- Enforcing agreements;
- Protecting our legal rights;
- Preventing fraud or misuse; and
- Maintaining appropriate business documentation.
The appropriate retention period may vary depending upon the type of information and the reason it was collected.
JMM Compliance does not promise to delete information immediately upon request where the information is reasonably necessary for a legitimate business purpose or where retention is permitted or required by law.
When information is no longer reasonably necessary and there is no legal or legitimate business reason to retain it, JMM Compliance may delete, destroy, anonymize, or otherwise dispose of the information in a manner reasonably designed to prevent unauthorized access or reconstruction.
16. PRIVACY REQUESTS
Subject to applicable law, individuals may contact JMM Compliance to request information concerning personal information we maintain about them.
Depending upon applicable law and the circumstances, a request may include asking us to:
- Confirm whether we maintain certain personal information;
- Provide access to certain personal information;
- Correct inaccurate information;
- Delete information that we are not legally or legitimately required to retain; or
- Explain how information is used or disclosed.
To protect privacy and prevent unauthorized disclosure, JMM Compliance may take reasonable steps to verify the identity and authority of a person making a privacy request.
We may decline or limit a request where permitted or required by applicable law, including where fulfilling the request would interfere with a legal obligation, regulatory requirement, contractual obligation, legitimate business purpose, or the rights of another person.
Privacy requests may be submitted to:

JMM Compliance may verify requests as reasonably necessary to protect the privacy and security of individuals and may apply legally permitted exceptions.
18. OTHER STATE PRIVACY RIGHTS
Residents of certain states may have additional privacy rights under applicable state law.
Because privacy laws vary by jurisdiction and their applicability may depend upon factors such as the size and activities of a business, JMM Compliance will address legally valid privacy requests according to the law applicable to the particular individual and circumstances.
Nothing in this Privacy Policy is intended to eliminate, waive, or restrict a privacy right that cannot legally be waived.
19. NEW YORK PRIVACY AND DATA SECURITY
JMM Compliance may provide services to carriers located in New York and may process information relating to individuals associated with those carriers.
Where applicable, JMM Compliance intends to maintain reasonable administrative, technical, and physical safeguards appropriate to the nature of information maintained and the reasonably foreseeable risks associated with its collection, storage, use, and disclosure.
JMM Compliance also intends to comply with applicable New York data-breach notification and privacy requirements.

If we learn that personal information from a child under 13 has been knowingly collected through our website without appropriate authorization, we will take reasonable steps to address the information consistent with applicable law.
21. THIRD-PARTY WEBSITES AND LINKS
The JMM Compliance website may contain links to third-party websites, including governmental websites, regulatory resources, service providers, technology providers, or other external websites.
A link to another website does not mean that JMM Compliance controls, endorses, or assumes responsibility for that website's privacy practices, security, content, or policies.
Users should review the privacy policy and terms applicable to any third-party website they visit.
JMM Compliance is not responsible for the privacy or security practices of third parties that operate websites or services outside of JMM Compliance's control.
22. BUSINESS TRANSFERS
If JMM Compliance Inc. is involved in a merger, acquisition, financing, reorganization, sale of assets, change of ownership, bankruptcy, dissolution, or other business transaction, information maintained by the business may be transferred as part of that transaction to the extent permitted by applicable law.
Any successor entity may be required to honor applicable privacy obligations relating to information transferred as part of the transaction.
23. CHANGES TO THIS PRIVACY POLICY

Changes may be necessary due to:

24. COMPLIANCE CONSULTING DISCLAIMER
JMM Compliance provides transportation, DOT, FMCSA, safety, regulatory, and compliance consulting services.
JMM Compliance is not a law firm and does not provide legal services or legal representation.
Information provided by JMM Compliance is intended to assist carriers and transportation businesses with compliance-related preparation, organization, documentation, administrative processes, and related matters.
Nothing on the JMM Compliance website or in communications from JMM Compliance should be interpreted as legal advice or as creating an attorney-client relationship.
Where a matter requires legal advice or legal representation, the carrier should consult a qualified attorney.
25. NO GUARANTEE OF COMPLIANCE OUTCOMES
JMM Compliance does not guarantee that a carrier will pass an audit, avoid a violation, avoid a fine, obtain a particular safety rating, have a violation removed, have a DataQs request granted, have an intervention closed, obtain regulatory approval, or achieve any particular result from a federal, state, or local regulatory agency.
JMM Compliance's role is to assist the carrier in identifying potential compliance issues, organizing relevant information, preparing documentation, developing compliance materials, and assisting the carrier in presenting information to the appropriate regulatory authority when such assistance is requested and authorized.
Regulatory agencies, including the FMCSA and other governmental authorities, maintain independent authority to review information, conduct investigations, issue violations, impose penalties, determine safety ratings, request additional documentation, approve or deny submissions, and take other regulatory actions.
JMM Compliance does not control the decisions of any regulatory agency.
Accordingly, the completion of a compliance review, audit-preparation service, corrective action plan, DataQs submission, safety program, policy, or other service does not constitute a guarantee that the carrier is or will remain fully compliant or that a regulatory agency will reach a favorable determination.
26. CARRIER RESPONSIBILITY
The carrier remains ultimately responsible for its own operations and compliance obligations.
JMM Compliance may assist a carrier with:
- Identifying potential compliance deficiencies;
- Preparing policies and procedures;
- Organizing records;
- Preparing audit materials;
- Preparing corrective action documentation;
- Reviewing information supplied by the carrier;
- Preparing submissions;
- Communicating with regulatory agencies when authorized;
- Providing compliance recommendations; and
- Other services described in an applicable service agreement.
However, JMM Compliance relies substantially upon information and documentation provided by the carrier, its officials, drivers, employees, agents, vendors, and other sources.
JMM Compliance is not responsible for undisclosed, inaccurate, incomplete, falsified, altered, outdated, or subsequently changed information supplied by a carrier or third party.
The carrier is responsible for reviewing information prepared on its behalf and for ensuring that information submitted to any regulatory authority is truthful, accurate, complete, and authorized.
27. NO GUARANTEE OF 100% COMPLIANCE
No consultant, software system, policy, review, or compliance program can reasonably guarantee that a motor carrier will have no violations or compliance issues.
JMM Compliance does not represent that use of its services will result in 100% compliance or eliminate every potential regulatory risk.
Compliance requirements can change, regulatory interpretations can vary, carrier operations can change, and violations can occur despite reasonable compliance efforts.
JMM Compliance's objective is to help carriers identify and address compliance risks and prepare appropriate documentation and procedures based upon the information available at the time of the engagement.
28. INFORMATION PROVIDED BY CARRIERS
JMM Compliance generally relies upon information provided by the carrier or obtained from sources reasonably believed to be reliable.
JMM Compliance does not independently guarantee the accuracy of every document, record, statement, governmental record, or other information provided to us.
A carrier's failure to disclose relevant information may affect the accuracy or completeness of the services provided.
If a carrier knowingly provides false, misleading, incomplete, altered, or fraudulent information, JMM Compliance reserves the right to decline, suspend, or terminate services and may take other action permitted by law.
29. REGULATORY AGENCIES
JMM Compliance may assist carriers in communicating with federal, state, or local regulatory authorities when authorized.
Such assistance does not mean that JMM Compliance is affiliated with, employed by, endorsed by, or acting as an agent of the FMCSA, U.S. Department of Transportation, state transportation agencies, or any other governmental authority unless expressly stated in a separate written agreement.
JMM Compliance is an independent private compliance consulting business.
30. DATAQS, AUDITS, CORRECTIVE ACTION PLANS, AND REGULATORY SUBMISSIONS
Where JMM Compliance assists with DataQs requests, safety audits, corrective action plans, interventions, petitions, responses, or other regulatory submissions, JMM Compliance assists in preparing and organizing information supplied by or on behalf of the carrier.
JMM Compliance does not control the agency's review process or final decision.
Submission of a document, request, appeal, DataQs request, corrective action plan, or other response does not guarantee approval, removal of a violation, reduction of a penalty, closure of an intervention, improvement of a safety rating, or any other favorable outcome.
31. CONSENT TO NECESSARY DISCLOSURES
When a carrier voluntarily engages JMM Compliance for services requiring communication with a third party, the carrier may authorize JMM Compliance to disclose or obtain information reasonably necessary to perform those services.

- Clearinghouse-related service providers;
- ELD providers;
- Insurance-related parties where authorized;

JMM Compliance will not intentionally use such authorization as permission to sell the carrier's information.
32. LIMITATION OF WEBSITE INFORMATION
Information published on the JMM Compliance website is provided for general informational and educational purposes.
Regulations, agency procedures, interpretations, forms, and requirements may change.
Website information may not reflect the most recent regulatory development applicable to a particular carrier, operation, vehicle, driver, jurisdiction, or circumstance.
Carriers should obtain individualized professional or legal advice where appropriate.
33. NO CREATION OF A CONSULTANT-CLIENT RELATIONSHIP THROUGH WEBSITE USE
Visiting the JMM Compliance website, reading website content, submitting a general inquiry, sending an email, or communicating with JMM Compliance does not automatically create a formal consulting engagement.
A consulting relationship may be established through an applicable written service agreement, engagement, invoice, payment arrangement, or other confirmation accepted by JMM Compliance.
The scope of services and responsibilities of JMM Compliance and the client may be further defined by the applicable service agreement.
34. YOUR RESPONSIBILITY TO REVIEW INFORMATION
Where JMM Compliance prepares documents, policies, submissions, letters, corrective action plans, or other materials on behalf of a carrier, the carrier remains responsible for reviewing the information before it is submitted or implemented.
The carrier is responsible for confirming that factual information concerning its company, drivers, vehicles, operations, records, and regulatory history is accurate and complete.
